Domestic care is a head of damages for additional assistance that the plaintiff
requires in their everyday living as a result of the injuries and disabilities
sustained in their accident. This care is often unpaid care by family,
friends and others.
Legislation often limits the level of gratuitious care that may be claimed. Past
gratuitious care is often limited to 40 hours per week and at an hourly rate
equal to average weekly earnings as published by the Australian Bureau of
Statistics.
